A Landlord's Guide to Legal Responsibilities in the UK

UK landlords have extensive legal obligations. This guide covers the key responsibilities you must meet to stay compliant and protect your tenants.

Being a landlord in the UK comes with significant legal responsibilities. Failure to meet these obligations can result in hefty fines, prosecution and even imprisonment in serious cases. Here's a comprehensive overview of what you're legally required to do.

Safety certifications

Gas safety: all gas appliances and flues must be inspected annually by a Gas Safe registered engineer. You must provide tenants with a copy of the Gas Safety Certificate within 28 days of each annual check.

Electrical safety: since 2020, landlords must ensure fixed electrical installations are inspected every 5 years by a qualified electrician and provide tenants with the Electrical Installation Condition Report (EICR).

Smoke and carbon monoxide alarms: at least one smoke alarm on each floor and a carbon monoxide alarm in any room with a solid fuel appliance are legally required.

Energy Performance Certificate (EPC)

Properties must have a minimum EPC rating of E to be legally let. From 2025, the government is proposing to raise this to C for new tenancies. Failure to comply can result in fines of up to £30,000.

Right to Rent checks

Landlords must check that all adult tenants have the legal right to rent in the UK before a tenancy begins. Failure to conduct these checks can result in fines of up to £3,000 per tenant.

Deposit protection

Tenancy deposits must be protected in a government-approved scheme within 30 days of receipt, and tenants must be provided with the scheme's prescribed information. Failure to protect a deposit can result in penalties of up to 3x the deposit amount.

Repairs and maintenance

Landlords are legally obliged to maintain the structure and exterior of their properties, ensure all installations for water, gas, electricity, sanitation and heating are in working order, and carry out repairs within a reasonable time.
